Futsal Court Waiver of Liability (sign version 6.15.2022)

There are inherent risks in using these futsal court facilities (“Facilities”). The risk of injury involved in using the Facilities is significant, including the potential for permanent paralysis and death, loss or theft of personal property; slips, trips, falls and other injuries; failure of equipment or Facilities; the presence of other futsal court users and possible negligence or unruly behavior on their part which could cause injury, and other risks.  BY USING THE FACILITIES, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. By using the Facilities, I consent to medical treatment, which may be deemed advisable in the event of injury, accident or illness occurring and agree that I am solely responsible for any hospital, medical or treatment costs arising out of any personal injury sustained by way of my use of the Facilities.  

By using the Facilities, I agree for myself (and my executors, next of kin, representatives, successors and assigns, and all members of my family) to: (A) waive, release and discharge from any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind and covenant not to sue, Hacienda CDC and its successors, assigns, employees, officers, directors, and other representatives (“Released Parties”); and (B) defend, indemnify and hold harmless the Released Parties from any and all liability, claims, damages or other loss made or incurred by other Released Parties, that arise as a result of my actions or inactions connected with my use of the Facilities.  

Existen riesgos inherentes al uso de estas instalaciones de la cancha de futsal ("Instalaciones"). El riesgo de lesión involucrado en el uso de las Instalaciones es significativo, incluido el potencial de parálisis permanente y muerte, pérdida o robo de propiedad personal; resbalones, caídas y otras lesiones; falla de equipos o Instalaciones; la presencia de otros usuarios de la pista de fútbol y posibles negligencias o comportamientos indisciplinados por su parte que puedan causar lesiones y otros riesgos. AL UTILIZAR LAS INSTALACIONES, ASUMO A CONOCIMIENTO Y LIBREMENTE TODOS LOS RIESGOS, tanto conocidos como desconocidos. Al utilizar las Instalaciones, doy mi consentimiento para recibir tratamiento médico, que puede considerarse aconsejable en caso de que ocurra una lesión, un accidente o una enfermedad, y acepto que soy el único responsable de cualquier costo hospitalario, médico o de tratamiento que surja de cualquier lesión personal sufrida de manera de mi uso de las Instalaciones.

Al usar las Instalaciones, acepto para mí (y mis albaceas, parientes más cercanos, representantes, sucesores y cesionarios, y todos los miembros de mi familia) a: (A) renunciar, liberarme de toda responsabilidad por mi muerte, discapacidad, lesión personal, daño a la propiedad, robo de propiedad o acciones de cualquier tipo y pacto de no demandar, Hacienda CDC y sus sucesores, cesionarios, empleados, funcionarios, directores y otros representantes ("Partes Liberadas"); y (B) defender, indemnizar y eximir de responsabilidad a las Partes exoneradas de toda responsabilidad, reclamo, daño u otra pérdida en la que incurran otras Partes exoneradas, que surja como resultado de mis acciones o inacciones relacionadas con mi uso de las Instalaciones .
